The Rise and Recklessness of Judge Shopping
How We Got Here
Judge shopping isn’t just a bad legal strategy—it’s an abuse of the system, and it was never meant to work this way. The judiciary was designed to interpret laws fairly, not to serve as a political weapon. But Democrats have twisted it into exactly that. Whenever Trump enacts an authority on an issue—whether it’s immigration, executive orders, or policies protecting American interests—they run straight to a friendly judge, usually appointed by a Democrat president, to get it overturned.
This isn’t just manipulation—it’s outright judicial malpractice. The law was never supposed to be a political chess game where one side picks a judge to guarantee a ruling. This is why we have an appeals process, and ultimately, the Supreme Court. But Democrats have sidestepped that by hunting for activist judges who will issue immediate nationwide injunctions.
How Far It’s Gone
What used to be an occasional loophole has become a full-blown obstruction strategy. The moment Trump takes action, you can predict where the lawsuit will be filed: a blue district with a left-leaning judge eager to strike it down. This isn’t about following the Constitution—it’s about overriding it.
We saw this under Trump’s first term, when nearly every major executive action was challenged in liberal courts. Now, it’s happening again, with leftist judges pushing their own agendas rather than upholding the law. This illegal abuse of the judiciary has turned lower courts into a second, unelected branch of government—one that Democrats use to block policies they don’t like.
How Far Will They Go?
At what point do these judges stop pretending they’re interpreting the law and just admit they’re acting as political operatives? How many more times will they rewrite the rules to serve Democrat interests? And if this continues unchecked, do we even have a functioning presidency anymore?
If a sitting president can be overruled by a single district judge handpicked by his opposition, then we’re no longer dealing with checks and balances—we’re dealing with judicial sabotage.
Will the Supreme Court Step In?
The Supreme Court has the power to shut this down, and it needs to. We’ve already seen them reverse some of these ridiculous rulings, but they need to go further. Judge shopping shouldn’t just be overturned on a case-by-case basis—it should be explicitly ruled as an abuse of judicial authority.
If SCOTUS doesn’t put a stop to this, then the left will continue using the courts as a weapon rather than a fair arbiter of justice. The law was never meant to work this way, and it is past time for real consequences for those who exploit it.
Conclusion
Judge shopping has turned the legal system into a joke. Democrats aren’t winning cases on merit—they’re winning by picking the judge. This is not just unfair, it’s illegal and unconstitutional. If this abuse isn’t stopped, Democrats will continue to use it to block Trump’s presidency at every turn. The Supreme Court has a choice: rein in this corruption, or let the judiciary become nothing more than a political arm of the Democratic Party—Brent Wiewel
